Article 1
The BCA Visa Corporate Card (“Card”) is the property of PT Bank Central Asia Tbk (“BCA”). The Card is issued by BCA at the request of the company that has obtained the BCA Visa Corporate Card facility from BCA (“Company”). The Card is issued for use by the person(s) designated by the Company (“Cardholder”) solely for the benefit of the Company.
Article 2
The Card is non-transferable and must be signed by the Cardholder whose name is printed on the Card and must not be used by another person that may succeed the Cardholder in position. During the validity of the Card, the Cardholder is the only person entitled to use the Card to make payment transactions to a merchant using the Card ("Merchant"), make cash withdrawals through ATMs, or withdraw cash at BCA branch offices/other banks that accept cash withdrawal transactions using the Card. BCA is not responsible for any refusal by the Merchant to accept payments using the Card.
Article 3
The Cardholder when using the Card must not exceed the maximum credit limit determined by BCA. Any amount of Card usage that exceeds the maximum credit limit (if any) must be paid in full no later than the due date of the billing month. Any card usage that exceeds the maximum credit limit may be subject to a penalty, the amount of which is determined by BCA and will be notified in any form and by any means in accordance with the applicable law. With the approval of the Company, the Cardholder may withdraw cash within a certain limit as determined and notified by BCA in any form and by any means in accordance with the applicable law, subject to an administration fee and interest on the cash withdrawal amount. The amount of administration fee and interest will be notified to the Company in any form and by any means in accordance with the applicable law. Interest is calculated from the date on which the transaction is recorded (posting date).
Article 4
The Company is fully responsible for the use of the Card including any misuse of the Card, either by the Cardholder or by any other people. Neither the Company nor the Cardholder may use the Card to conduct transactions that violate the applicable law. All charges and fees incurred in connection with the use of the Card by the Cardholder are the full responsibility of the Company, without prejudice to BCA’s right, if deemed necessary by BCA, to collect such amounts directly from the Cardholder for the transactions conducted using the Card.
Article 5
Article 6
If the Card is lost, the Company and/or the Cardholder must immediately report the loss to HALO BCA (24-hour service) or a BCA branch office (during the operating hours of such BCA branch office). If necessary, BCA, the Company, and/or the Cardholder must provide a written notification of loss signed by the Company and/or the Cardholder in the form and substance satisfactory to BCA. The Company is responsible for all existing card transactions until BCA receives the notification of loss from the Company and/or the Cardholder. For card replacement, the Company will be charged a card replacement fee, the amount of which is determined by BCA. The lost card that has been reported in the notification of loss cannot be used any longer.
Article 7
BCA will impose a late charge for each monthly balance that remains unpaid after the due date as well as interest at the then applicable rate, calculated from the transaction posting date. BCA has the right to determine the amount of the late charge and interest, which will be notified by BCA to the Company in any form and by any means in accordance with the applicable law.
Article 8
BCA is not responsible for any defects and deficiencies of any nature in the goods or services purchased and paid for using the Card. In the event of a dispute over the purchase of the goods or payment for the services, the Company remains obligated to pay the amount as specified in the Billing Statement.
Article 9
If BCA receives the billing amount from the merchant in a currency other than rupiah, BCA will convert the amount into rupiah based on the exchange rate determined by BCA on the date BCA receives the billing data.
Article 10
BCA has the right to determine the credit limit for the Card, the amount of which will be notified to the Company and/or the Cardholder. The credit limit may be reduced or unconditionally canceled at any time by BCA. The credit limit may also be automatically canceled if the condition of the Company and/or the Cardholder drops to substandard (kurang lancar), doubtful (diragukan), or bad (macet). BCA under certain considerations has the right to block the Card, terminate the use of the Card, and revoke all rights attached to the Card, among others, if the Company and/or the Cardholder uses the Card to conduct any transactions that violate the applicable law, uses the Card for purposes other than as a payment instrument, or if there is an indication that the Company and/or the Cardholder uses the Card to make cash withdrawal/swipe transactions at the Merchant. BCA has the right to notify the Merchant of the above matters, if necessary. If the use of the Card is terminated, BCA has the right to block the Card and the Company is obliged to pay off all outstanding amounts arising from the use of the Card to BCA immediately in full amount on the Card termination date. The Company and BCA agree to waive the provisions of Article 1266 of the Indonesian Civil Code to the extent that a court decision is required to terminate an agreement, and therefore the Card termination does not need a court decision.
Article 11
The PIN (Personal Identification Number) can be used by the Cardholder to withdraw cash and/or conduct other types of transactions. Such other types of transactions are determined by BCA and will be notified in any form and by any means in accordance with the applicable law. The Cardholder must maintain the confidentiality of the PIN and must not store the PIN and the Card at the same place. The Cardholder is fully responsible for the use of the PIN and any misuse of the PIN, whether by the Cardholder or by other people.
Article 12
As long as the Company still has outstanding obligations to BCA related to the use of the Card, the Company and/or the Cardholder hereby authorizes BCA to block and/or debit any savings account, checking account, time deposit, and/or other accounts of the Company and/or the Cardholder at BCA, and use the proceeds to pay all of the Company's debts and obligations to BCA, including the principal, interest, penalties, court fees, and other costs and fees. All consequences arising in connection with the debiting of the accounts of the Company and/or the Cardholder under such authorization will be the full responsibility of the Company and/or the Cardholder.
Article 13
If the Company is a Merchant, BCA reserves the right to suspend any payments, block and/or debit the Merchant's account or set off any unpaid sum as well as its interest, penalties, and other costs and fees against the Merchant’s claims to BCA.
Article 14
The Card is only valid until the last day of the month and year as stated on the Card and will be automatically renewed by BCA, unless the Company requests BCA to terminate the Card before its expiration date or BCA under certain considerations terminates the Card before the expiration date.
Article 15
If the Company intends to terminate the use of the Card, the Company must notify BCA of such intention at least 1 (one) month prior to the intended Card termination date.
Article 16
The Company hereby acknowledges that all records, printouts, recordings, communication media, or any other evidence held by BCA connected with the transactions conducted by the Cardholder constitute valid and conclusive evidence binding on the Company, unless proven otherwise.
Article 17
The Company must immediately notify BCA of any change of the Company's address and/or telephone number. All consequences arising from a delay in or non-receipt of the Billing Statement due to the Company's failure to notify any changes to the Company's data will be the full responsibility of the Company and or the Guarantor. The delay or non-receipt of the Billing Statement will not relieve the Company of its obligation to pay the billing amount arising from the use of the Card, including the late charge and interest, in accordance with the applicable provisions at BCA.
Article 19
BCA reserves the right to debit the Company's account and use the proceeds to pay all costs and fees incurred to recover all amounts due to BCA from the Company, including any attorneys’ fees, court costs, and agency fees if BCA appoints or authorizes other persons to collect such amounts from the Company.

Article 25
Any failure and/or delay by BCA in exercising any of its rights, powers or privileges under these Terms and Conditions for BCA Visa Corporate Card does not operate as a waiver by BCA of such rights or powers, and the exercise of any one or part of the rights, powers or privileges under these terms and conditions does not preclude BCA from any further exercise of such rights or powers or from the exercise of any other rights, powers or privileges.
